Preambles recites that the City of Farmington adopted Ordinance No. 2015-1274 (the "Ordinance") on January 13, 2015 authorizing a wastewater construction loan not to exceed $14,000,000 plus construction interest from the New Mexico Environment Department ("NMED"), entered into an interim Loan Agreement with NMED dated February 3, 2015 and executed and delivered an Interim Promissory Note dated January 22, 2015 in the maximum principal amount of $14,000,000 plus construction interest; after the receipt of construction bids on the wastewater treatment facility improvements, it was determined that the cost of such improvement is substantially higher than estimated, the City determined that the loan should be increased from $14,000,000 plus construction interest to $22,000,000 plus accrued construction interest and NMED has agreed to such higher amount; that such Ordinance, Note and Loan Agreement be amended; and clarifies two definitions in the Ordinance. Sections 1 through 3 and 5 amend the Ordinance, Note and Loan Agreement to provide that the Project (the bettering and improving of the City's Sanitary Sewer System by extending, enlarging, bettering, repairing and otherwise improving the City's existing wastewater treatment facility) and Loan shall not exceed $22,000,000 plus accrued construction interest instead of $14,000,000 plus accrued construction interest. Section 4 amends the Note and Loan Agreement to increase the substantially equal annual repayment amount of the final Loan to be amortized over 20 years. Section 6 amends Section IV of the Loan Agreement to extend the construction completion date to January 31, 2019 instead of July 31, 2018. Section 7 amends paragraphs B and C of Section VI of the Loan Agreement to appropriately change the Amount Financed, Interest Charges Payments, Administrative Fee Payments, Total of Payments and the times When Payments Are Due. Sections 8 and 9 delegate authority to sign documents to an Authorized Officer and City Clerk and provide that the other provisions of Ordinance No. 2015-1274 not expressly amended by this ordinance remain in full force and effect. Sections 10 and 11 are severability and repealer provisions and Section 12 relates to adoption of this ordinance, including passage by 3/4ths of all members of the Council.
